By signing in, using, or accessing SKYCUT ("the Service") in any way, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

1. What SKYCUT is (AI disclosure)

SKYCUT is an automated video editing tool. Artificial intelligence is used to analyze still frames sampled from footage you provide and to plan an edit. The AI does not generate video content: every frame in your output file comes from footage you supplied. The soundtrack is synthesized by the Service. Results vary with your footage; we make no guarantee about the quality, length, or character of any output.

2. Your footage, your responsibility

• Only process footage you own or have permission to use. You keep all rights to your footage and to your edited output.
• You are responsible for complying with drone/aviation laws and privacy laws wherever you fly and film.
• Do not use the Service to process unlawful content of any kind.

3. Age requirement

You must be at least 13 years old to use the Service (COPPA). If you are under 18, use the Service only with a parent or guardian's permission.

4. As-is, no warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your expectations. Processing happens on your own device; you are responsible for keeping copies of your original footage.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF SKYCUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, FOOTAGE, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED TEN US DOLLARS (US$10) OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

6. Assumption of risk & indemnification

You use the Service at your own risk. You agree to indemnify, defend, and hold harmless the operator of SKYCUT from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your footage, your outputs, or your violation of these Terms or any law.

7. Acceptable use

Do not attempt to abuse, overload, reverse engineer, or attack the Service or its AI proxy; do not use automated tools to hammer the API; do not resell the Service.

8. Sensitive information

Do not submit passwords, government ID numbers, financial or medical information through the Service. Anything you choose to include in footage or messages is at your own risk.

9. Dispute resolution — binding arbitration & class action waiver

Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration under the rules of the American Arbitration Association, rather than in court, except that either party may bring a claim in small-claims court. YOU AND SKYCUT EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Disputes must be brought individually.

10. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.

11. Changes & termination

We may modify, suspend, or discontinue the Service (or these Terms) at any time. Continued use after changes means you accept the updated Terms.

12. Severability

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force.
